Founding attorneys Christina Roberto and Raymond J. Tittmann published a noteworthy article on the coverage issues relating to opioids in Law360, entitled “5 Insurance Coverage Questions Raised by Opioid Litigation.” The article noted three issues that have and three issues that have yet to be litigated in the young field of opioid coverage litigation.
The main items addressed included application of a policy’s self insured retention when another carrier is defending, bodily injury coverage and exclusions, and continuing act exclusions, among other items.
